Terms of Service
Last Updated: September 4, 20261. Overview
Welcome to Kadmium (https://www.kadmium.dev), engineered and operated by Emil Fredrik Sjöstedt ("Kadmium", "we", "us", or "our"). This website serves as the official portal, documentation repository, and distribution platform for our Unreal Engine 5 (UE5) plugins, C# developer utilities, game frameworks, and video games.
By accessing or browsing this website, downloading compiled applications, purchasing source code, or playing our games, you agree to be bound by these Terms of Service.
2. Purchases, Merchant of Record & Storefronts
Authorized Merchant of Record (Gumroad): For products purchased directly through our website, our authorized Merchant of Record, Gumroad, handles order processing, secure payment execution, applicable VAT/sales tax collection, and customer invoicing. These transactions are subject to Gumroad's checkout terms and conditions.
Third-Party Marketplaces (Epic Games / Fab): If you license or purchase our plugins, blueprints, or assets through third-party platforms (such as the Epic Games Store or Fab), the transaction, order delivery, and storefront terms are governed entirely by that specific platform’s agreements.
Applicable License Contracts:
Developer tools, plugins, and source code packages are strictly governed by our Software & Source Code License Agreement.
Standalone video games and playable clients are governed by our End User License Agreement (EULA).
3. Refunds & Order Fulfillment
Billing and Fulfillment Channels: Any order discrepancies, invoice requests, or billing inquiries must be submitted through the merchant or storefront where the purchase was completed (e.g., Gumroad or Epic Games / Fab).
Digital Goods & Source Code Policy: Because downloadable source code solutions (including .sln, .cs, and C++ source packages) consist of uncompiled, irrevocable digital intellectual property, all source code sales are final and strictly non-refundable once access or download is granted.
Compiled Applications & Tools: Pre-compiled standalone applications and desktop utilities are provided free of charge or in accordance with consumer rights applicable via the merchant of purchase.
4. Intellectual Property
All content hosted on this site, distributed in our tool suites, and embedded in our games—including text, brand marks, logos, user interfaces, C++ source code, C# architectures, shaders, art assets, and audio—remains the exclusive intellectual property of Kadmium (Emil Fredrik Sjöstedt) or its respective licensors.
Unreal Engine® is a registered trademark of Epic Games, Inc. Kadmium is an independent software studio and is not directly affiliated with, sponsored by, or endorsed by Epic Games, Inc.
5. Telemetry & Crash Reporting
Our compiled tools, launcher services, and video games may include opt-in or anonymized technical telemetry (such as crash dump reporting and basic analytics via Google Analytics) solely for stability diagnostics, frame-rate profiling, and security patching. We do not harvest, track, or sell personally identifiable user information through these operational diagnostics.
6. User Communications & Feedback
When submitting bug reports, architecture proposals, or technical inquiries via our contact channels:
You warrant that submitted logs or materials do not contain malicious code, spyware, or confidential third-party proprietary data.
Any technical suggestions, workflow concepts, or feature requests you submit may be integrated into future iterations of our tools, frameworks, or games without any obligation, royalty, or compensation owed to you.
7. Disclaimer & Limitation of Liability
This website, our developer tools, frameworks, and games are provided on an "as-is" and "as-available" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable Swedish and European Union law, Kadmium shall not be held liable for any indirect, incidental, punitive, or consequential damages (including loss of data or business disruption) resulting from the use or inability to use our software.
8. Governing Law & Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of Sweden, harmonized with applicable European Union consumer regulations. Any dispute, controversy, or claim arising out of or in connection with these Terms shall be settled by the public courts of Sweden, with the Stockholm District Court (Stockholms tingsrätt) serving as the court of first instance.
